Tesco given go-ahead to extend its Burnham-On-Sea store

Planning bosses have this week granted permission to Tesco to extend its Burnham-On-Sea store – but placed 19 conditions on the company.

The supermarket giant had applied for permission to build extensions to its South and East elevations and create a new formation of access at its store in Ben Travers Way.

The firm also wanted to introduce a revised car parking layout and make changes to its service yard.

The application was considered by Sedgemoor District Council’s development control committee on Tuesday (July 28th), when the scheme was given a green light.

But the committee also placed a number of planning conditions on the store, as outlined below.

.PLANNING CONDITIONS PLACED ON TESCO BURNHAM-ON-SEA:

The following nineteen planning conditions have been placed on Tesco by the district council as part of its approval of the store’s extension:

1. The development hereby permitted shall be begun before the expiration of three years from the date of this permission In accordance with the provisions of Section 91 of the Town and Country Planning Act, 1990.

2. Samples of the roofing materials and of the materials to be used in the construction of the external walls shall be submitted to and approved in writing by the local planning authority before any work is commenced. Reason: In the interests of visual amenity.

3. Details of all proposed signage to the building and external areas, including car park and access, shall be submitted to and approved in writing by the local planning authority prior to the commencement of operation of the extended store. Reason: In the interests of visual amenity.

4. All hard and soft landscape works shall be carried out in accordance with the approved details. The works shall be carried out prior to commencement of operation of the extended store or in accordance with the programme agreed with the local planning authority. The trees/shrubs shall be protected and maintained, and dead or dying trees/shrubs shall be replaced to the satisfaction of the local planning authority for a period of five years following their planting. Reason: In the interest of visual amenity.

5. The development hereby granted permission shall not commence until the new access works shown on Drawing No. F/EXT/506-PL221 are completed to the satisfaction of the Local Planning Authority and the Highway Authority and the dedication of land shown on drawing 0308-16/PL3 (Appendix S in the Transport Assessment) has taken place. Reason: In the interests of highway safety and to provide for orderly development.

6. Before the extended store is open to the public the proposed new or altered internal circulation roads, car parking, cycle parking, footpath /cycleway, bus lay-by and shelter, turning and servicing areas shall have been constructed, surfaced, lit and completed in accordance with detailed plans and specifications to be submitted and approved in writing by the Local Planning Authority and the Highway Authority. Reason: In the interests of highway safety and to provide a safe and sustainable form of development.

7. No more than 20% of the net sales floorspace shall be used for the sale of durable goods, to comprise clothing, electrical goods, books, toys, entertainment media, kitchenware and hardware. Reason: To protect the viability and vitality of nearby shopping centres.

8. No goods, waste or other items or materials shall be stored or displayed in the open on the site, including the shop forecourt or entrance way, without the prior written approval of the local planning authority. Reason: In the interests of visual amenity.

9. The store shall not be open for business outside the hours of 7.30 am to 10.30 pm Monday to Saturday and 10 am to 5 pm Sunday. Reason: To protect the amenities of nearby residents.

10. There shall be no deliveries to the store by service vehicles after 10.00 pm or before 7.00 am on any day and no delivery vehicles shall park or stand on the access road leading to the service area, or on Ben Travers Way, between these hours. Reason: To protect the residential amenity of proposed and existing homes adjoining the site.

11. No system of public address, loudspeaker system or amplified music shall be operated outside the store without the prior written permission of the local planning authority. Reason: To safeguard local residents from noise and disturbance.

12. The development hereby permitted shall not give rise to noise levels greater than 8 dB LAeq (60 min) above the prevailing background level as described in BS4142:1997 when measured at the facade of the nearest noise sensitive dwelling. Reason : To safeguard local residents from noise and disturbance.

13. Before the development commences, a scheme shall be submitted, and approved in writing by the local planning authority, which specifies the provision to be made for control of noise emanating from fixed plant and machinery at the extended store. This scheme shall be implemented and complied with at all times during the operation of the store. Reason: in the interest of the amenities of local residents

14. No construction work, other than completely internal fitting out, shall take place outside the hours of 7am to 6pm Mondays to Fridays, 7am to 1pm on Saturdays with the exception of specific works which shall have been agreed in advance and in writing by the local planning authority and shall include details of the task, the date and duration of works. Reason: In the interest of the amenities of local residents

15. The proposed external lighting scheme for buildings, service yard and car park areas shall be submitted and approved in writing by the local planning authority prior to opening of the extended store. The lighting shall be installed and operated in accordance with the approved scheme. Reason: To protect the amenities of nearby properties.

16. Development shall not begin until a surface water drainage scheme for the site, based on sustainable drainage principles and an assessment of the hydrological and hydrogeological context of the development, has been submitted to and approved in writing by the Local Planning Authority. The scheme shall subsequently be implemented in accordance with the approved details before the development is occupied. Reason: To prevent the increased risk of flooding, to improve and protect water quality and improve habitat and amenity.

17. The development shall not be commenced until such time as a scheme to deal with foul water drainage has been submitted to, and approved in writing by, the Local Planning Authority. The site must be drained by a separate system of foul and surface water drainage. There shall be no discharge of foul or contaminated drainage or trade effluent from the site into either groundwater or any surface waters, whether direct or by soakaways. Inspection manholes shall be provided and clearly identified. The scheme shall be implemented as approved. Reason: To prevent the pollution of the water environment and enable monitoring.

18. The development permitted by this planning permission shall only be carried out in accordance with the approved Flood Risk Assessment (FRA) dated August 2008 and the following mitigation measures detailed within the FRA: Identification and provision of safe route(s) into and out of the site to an appropriate safe haven. Flood-proofing measures detailed on page 19 in the proposed development specifically flood proofing the building to a level of 6.3 metres Above Ordnance Datum. Finished floor levels are set no lower than 5.75 metres Above Ordnance Datum. Car Park ground levels are to be set no lower than 5.50 metres above Ordnance Datum. Reason: To ensure safe access and egress from and to the site and to reduce the risk of flooding to the proposed development and future occupants.

19. The clearance between the existing public sewer and the extension permitted by this planning permission must not be less than 5 metres. Reason: To protect the sewer from structural damage and collapse, to prevent flooding and pollution, and to ensure safe access for maintenance and repair.
